NeoItems.net: Neopet Related Images.

As some of you already know Neopets have been contacting websites and explaining what can and cannot be done with their images. As the copyright holders this is their right and therefore I will be complying with their wishes. I asked them if these rules will apply to all websites in the future and this was their response:

"Eventually, we hope to have all websites in compliance with our Terms and Conditions."

Something for you all to bear in mind.

1) Making any derivative works using NeoPets' protected images.

: Basically we are not allowed to edit any images obtained from their website in any way at all. This includes making backgrounds, blinkies, even just resizing or adding text. You many not even edit their images for use in your Neopet shop, user lookup etc. (I imagine that the Beauty Contest, Art Gallery and Neopian Times are exceptions though please do not quote me).

2) Drawing Neopet related images from scratch.

: If you want to draw Neopet pictures, create sprites etc. then of course it is completely upto you but the rules for placing them on websites, your Neopet shop, user lookup etc. is exactly the same as above.

This is an exact quote from their letter:

"As we have previously stated, under Section 4 of the Agreement your are prohibited from making any derivative works using NeoPets' protected images or marks. This includes any backgrounds, whether they are on your fan site or in your shops, pet pages, and user look-ups. This also includes any NeoPets images which you have drawn from scratch. You must understand that when you place any derivative works on your site or in your shop, that itself is a redistribution to the public and is not permitted under the terms of the Agreement."

3) Unedited Neopet Graphics

: Unedited Neopet graphics can be displayed on websites, user lookups etc. provided you do the following:

"Place either 'NeoPets and all related names, characters, logos and indicia are trademarks of NeoPets, Inc., Copyright 2003. All rights reserved. Used with permission.' or 'TM & © 2003 NeoPets, Inc. All rights reserved. Used with permission.' as the first attribution on every page that contains the NeoPets Names and/or Images;"

Because of this I will unfortunately have to remove most of the themes from the forum, the sprites, my avatar and my blinkie. I would ask you to please also remove any edited Neopet graphics from your settings too. As mentioned in (3) above you can still use an image from their server as your avatar as long as you have not changed it in any way.
